Terms & Conditions of Sale
1. Who we are
This website is operated by Emotive (UK) Limited, a company registered in England and Wales under company number 04211380, whose registered office is Dalton House, 60 Windsor Avenue, London, SW19 2RR. "Emotive Art Prints" is a trading name of Emotive (UK) Limited. You can contact us at {{EMAIL}}.
2. These terms
These terms apply to every order placed through this website. Please read them before ordering. By placing an order you agree to them. If you are a consumer, nothing in these terms affects your statutory rights.
3. How a contract is formed
Placing an order is an offer to buy. We will acknowledge your order by email, but a contract is formed only when we send you a dispatch confirmation. If we cannot accept your order — for example because an item is unavailable or a price was listed incorrectly — we will tell you and refund any payment in full.
4. Products
Images on this website are intended to show the product accurately, but colours may appear differently depending on your screen. Print sizes follow the international A-series and are stated in millimetres and inches on each product page.
Handmade pieces are made individually from natural materials. Each varies in shape, colour, grain and proportion, so the item you receive will not be identical to the photograph. This is a characteristic of the product rather than a defect.
5. Price and payment
Prices are shown in pounds sterling and include VAT where applicable. {{VAT_LINE}} Delivery charges are shown separately before you confirm your order.
We take payment at the point of order through our payment provider, PayPal (which also accepts credit and debit cards without a PayPal account), with basket and checkout provided by Mal's E-commerce. We do not store your card details.
If a product is listed at an incorrect price due to an obvious error, we are not obliged to supply it at that price. We will contact you before dispatch.
6. Delivery
We sell to United Kingdom delivery addresses only. Delivery times, costs and areas served are set out on our Delivery & Returns page. Goods become your responsibility once delivered to the address you gave us. If delivery is delayed by an event outside our control, we will tell you as soon as possible.
7. Cancellation and returns
Consumers have a statutory right to cancel within 14 days of receiving the goods, and we also offer a voluntary 30-day returns policy. Full details, including how to cancel and who pays return postage, are on our Delivery & Returns page.
8. Faulty goods
Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. If goods are faulty you may have the right to reject them, or to a repair, replacement or refund. These rights are in addition to anything in these terms.
9. Intellectual property
All artwork, images, text and design on this website are protected by copyright and may not be reproduced, copied or resold without written permission. Buying a print gives you ownership of that physical item only — it does not transfer any copyright or grant any right to reproduce the artwork.
10. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights as a consumer. Otherwise, we are not liable for losses that were not foreseeable at the time the contract was made.
11. Complaints
If something has gone wrong, please contact us at {{EMAIL}} and we will try to resolve it. If we cannot, you may be able to use an alternative dispute resolution service.
12. Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
